Health and Environmental Groups Challenge EPA’s Rollback of Mercury Emission Protections

A broad coalition of public health organizations and environmental advocates has filed a lawsuit in the U.S. Court of Appeals for the D.C. Circuit to block the Trump administration’s repeal of the Mercury and Air Toxics Standards. These regulations, which have been in effect since 2015, were instrumental in reducing mercury emissions from coal-fired power plants by over 90 percent. By challenging the EPA’s decision, the plaintiffs aim to restore federal safeguards that mitigate risks of cancer, respiratory disease, and neurological damage linked to toxic air pollutants.

The legal action also contests the agency's decision to dismantle real-time emissions monitoring requirements, which previously provided local communities with transparent data regarding air quality. Critics argue that the repeal ignores established scientific evidence and violates the Clean Air Act, noting that emissions of sulfur dioxide and mercury have already spiked since the administration began granting exemptions to coal plants. With 93 percent of the nation’s coal capacity already in compliance with the original standards, the coalition asserts that the rollback is an unnecessary and dangerous departure from the EPA’s core mission to protect public health. The litigation represents a significant effort to hold the government accountable for the environmental and medical consequences of increased industrial pollution.
