Wisconsin Man Convicted of Homicide Following Fatal Shooting of Brother Amidst Paranoia

A Milwaukee jury has found 51-year-old Brandon Smith guilty of first-degree reckless homicide for the fatal shooting of his 41-year-old brother, Justin Smith. The incident occurred on February 26, 2025, at the family home on North 47th Street. Prosecutors presented evidence showing that the defendant, who had been living with his mother and brother following a divorce, harbored unfounded suspicions that his brother was involved in an intimate relationship with his ex-wife. Despite his mother’s repeated attempts to de-escalate the situation and her assurances that no one else was present in the home, Brandon Smith remained convinced that his brother was conspiring to kill him.

The confrontation escalated in the early morning hours when Brandon Smith attacked his brother with a hammer before ultimately retrieving a handgun and firing a fatal shot into his chest. Following the shooting, the defendant prevented his mother from contacting emergency services for a period of time while he reportedly made erratic comments regarding biblical themes and his perceived safety. When police arrived at the scene, they discovered Justin Smith deceased with multiple blunt force injuries and a gunshot wound. Brandon Smith, who was initially charged with first-degree intentional homicide, now awaits sentencing on June 5.
