Georgia Man Sentenced to Life in Prison After Fatal Shooting During Child Visitation

Nicholas Mimms, 37, has been sentenced to life in prison with the possibility of parole for murdering Eduardo Figueroa, the ex-fiancé of his wife, during a child visitation on August 7, 2021. Figueroa had recently gained parental rights and arrived at Mimms’ home with a stuffed animal for their child when he was fatally shot by Mimms, who was wearing a bulletproof vest and armed.

Mimms was convicted of felony murder, aggravated assault, and possession of a firearm during the commission of a felony after a two-week trial in February 2024. Twenty-five witnesses testified during the proceedings, leading to his guilty verdict. During sentencing on April 16, Mimms received a life sentence plus an additional five years, with no contact allowed with Figueroa’s family.

Assistant District Attorney Megan S. Hertel highlighted the contrasting intentions of the two men involved: Figueroa arrived with love and excitement for his child, while Mimms came prepared for violence. District Attorney Susan K. Treadaway emphasized that the sentence ensures accountability for taking a father from his child and altering the lives of those left behind. The case underscores the tragic consequences of violence during visitation exchanges and serves as a stark reminder of the potential dangers involved in such situations.
