Defense Seeks to Exclude Officer’s Testimony About 'Clearly Pregnant' Brianna Moore

Brianna Moore, a 21-year-old college student from Tampa, Florida, is facing multiple charges including aggravated manslaughter of a child and child neglect after she allegedly gave birth and left her newborn in the trash. Attorneys for Moore are now seeking to exclude testimony from a police officer who claims that surveillance footage showed Moore appearing "clearly pregnant" before the incident.

In a motion filed on Monday, Moore's legal team requested that the court prevent a specific police officer from testifying about his interpretation of the video evidence. The defense argues that the video itself has been destroyed and is no longer available for review by the jury. Therefore, allowing an officer to characterize what he saw in the footage would be prejudicial and not aligned with Florida's legal standards.

The motion further asserts that "Florida appellate courts have repeatedly cautioned against permitting witnesses to summarize or characterize recordings that jurors cannot see." The defense contends that such testimony amounts to an impermissible argument by the prosecution, suggesting that Moore must have known she was pregnant.

Moore’s attorneys argue that there is no evidence indicating she recognized her pregnancy until the moment of delivery. They point out that all individuals who interacted with Moore during her pregnancy did not perceive her as visibly pregnant and stated that they had no indication she believed herself to be so.

Additionally, Moore's defense has requested a 12-person jury for her trial, despite Florida law stipulating that only capital cases are heard by such juries. The standard for non-capital cases in Florida is a six-member jury panel. This request underscores the gravity and complexity of the case from the defense’s perspective.

Moore was arrested on October 30, 2024, and has been held without bond at the Hillsborough County jail since then. She recently filed another motion seeking release on bail while awaiting trial.
