Florida Man Convicted of Second-Degree Murder for Shooting Estranged Wife's Fiancé

A Palm Beach County jury has found Brian Canarelli, 46, guilty of second-degree murder in the shooting death of James "Cole" Berger, 37, outside Berger’s home in Jupiter, Florida. The incident occurred on June 23, 2021, at approximately 2:35 a.m., when Canarelli arrived to pick up his son from his estranged wife's residence.

According to court documents and witness statements, the altercation began after Canarelli’s ex-wife called him to retrieve their child. Upon arrival, Berger became upset that Canarelli was there and an argument ensued. The situation escalated rapidly as Berger jumped over a gate separating the property from the street, despite his fiancée attempting to open it for the couple's son.

Berger's fiancée reported hearing a gunshot after her partner leaped over the fence but did not witness the shooting itself. She stated that Canarelli admitted to firing shots while she attempted CPR on Berger. In contrast, Berger’s mother provided a more detailed account of the incident, claiming that Canarelli fired one shot initially and then walked up to the fallen victim to deliver four additional rounds.

The tragic event left Berger dead at the scene from multiple gunshot wounds. Investigators discovered six spent 9 mm shell casings near the crime site and found a pistol in Canarelli's Porsche Cayenne parked nearby. The jury deliberated for several days before reaching its verdict, rejecting the more severe charge of first-degree murder.

The conviction carries mandatory minimum sentencing enhancements due to the use of a firearm during the commission of a violent crime. Circuit Judge John Parnofiello has delayed sentencing pending completion of a presentencing investigation requested by Canarelli's defense team.
