Former SEC Acting Chair Allison Herren Lee Joins Labaton to Lead Whistleblower Practice
Former SEC Acting Chair and Commissioner Allison Herren Lee has joined the law firm of Labaton Keller Sucharow to lead its newly established Whistleblower Representation Practice. The initiative, which also includes former SEC Senior Counsel Andrew Feller, aims to provide robust legal support for individuals who report securities violations.
Eric J. Belfi, Chairman of Labaton Keller Sucharow, emphasized the firm's commitment to protecting investors and promoting corporate accountability through this new practice. "Allison and Andrew have a deep understanding of how whistleblower protections operate within regulatory frameworks," said Belfi. Their combined expertise will enhance Labaton’s ability to advocate for whistleblowers effectively.
Lee’s tenure at the SEC saw significant advancements in whistleblower policies, including stronger protections and greater individual accountability for securities law violations. As the only former SEC Commissioner and Acting Chair currently representing whistleblowers in private practice, Lee offers a unique perspective on regulatory processes and enforcement decisions. "Whistleblowers are crucial to maintaining market integrity," she stated. "They need experienced advocates who understand both the legal complexities and personal risks involved."
Andrew Feller, with over 25 years of experience at the SEC’s Division of Enforcement, brings extensive knowledge in handling complex financial instruments and securities law violations. His role as Principal Enforcement Counsel and Senior Policy Advisor to Commissioner Lee further strengthens Labaton's capabilities.
The practice will cover all aspects of whistleblower representation, from initial consultations to award applications. "We help whistleblowers navigate the regulatory process," explained Lee. This includes assessing whether their information qualifies for submission under whistleblower protection laws, assisting with anonymous filings, and supporting clients throughout any ensuing investigations or legal proceedings.
Lee’s appointment by President Donald Trump and subsequent service during President Biden's administration highlight her bipartisan approach to regulation. She noted that the SEC is currently understaffed on the Democratic side, which has implications for regulatory balance and enforcement effectiveness. "The current makeup of the SEC lacks diversity in political viewpoints," Lee observed, stressing the importance of a balanced commission.
This development underscores the growing recognition of whistleblowers as key stakeholders in maintaining financial market integrity. With Labaton's resources and expertise, Lee aims to provide unparalleled support to those who expose fraudulent activities, thereby enhancing transparency and trust within the securities industry.
