
Court Rules Government Likely Violated First Amendment in Coercing Removal of ICE-Related Content
The court has ruled that the government likely violated the First Amendment by coercing Apple and Facebook into removing platforms related to ICE activity. Plaintiffs Kassandra Rosado, who runs the "ICE Sightings – Chicagoland" Facebook group, and Kreisau Group, creators of the "Eyes Up" app, allege that the government pressured these companies to take down their content. The court found that the injuries were likely traceable to government coercion rather than independent actions by the platforms.
In October 2025, Rosado's Facebook group was disabled after Laura Loomer highlighted it on social media, prompting government officials to claim credit for its removal. Similarly, Apple removed the "Eyes Up" app and others like ICEBlock following direct demands from the Department of Justice. The court noted that both platforms had previously approved the content, with no prior issues raised until after government intervention.
The judge emphasized that government coercion to suppress speech violates First Amendment rights, regardless of whether it directly regulates or pressures third parties. This ruling highlights a significant legal challenge in balancing free expression with government oversight in digital spaces.
