Silent Killer in Countertops: Rise of Artificial Stone-Related Silicosis Lawsuits

James Nevin, a seasoned toxic tort trial lawyer with over 25 years of experience litigating asbestos and mesothelioma cases, has found himself at the forefront of a new wave of litigation involving artificial stone and silicosis. This emerging legal battle began when a small law firm in Long Beach approached him with 25 cases of workers who had developed silicosis after exposure to artificial stone. Nevin, who specializes in toxic torts, initially knew little about this type of case but quickly realized its potential magnitude.

Artificial stone, widely used for kitchen and bathroom countertops, contains up to 95% crystalline silica, a substance known to cause silicosis, a debilitating and often fatal lung disease. Unlike natural stone, which has lower silica content and larger particles that are less likely to be inhaled, artificial stone is made by crushing and pulverizing quartz into nanosized particles. These tiny particles can easily enter the lungs, leading to severe health issues even in state-of-the-art fabrication facilities.

Nevin compared the situation to the asbestos crisis, where companies knew the risks but failed to act. He noted that while some manufacturers have reduced silica content in their products, they continue to sell higher-risk materials alongside safer alternatives. This has left workers, many of whom are young and previously healthy, facing life-threatening illnesses due to occupational exposure. As more cases emerge, Nevin and his team are preparing for what could become one of the largest toxic tort litigations in recent history.
