
Washington Boy Crushed to Death by Unstable Monument at Public Park
A 3-year-old boy named Kaleb Ortega tragically died after being crushed by a monument in Rooks Park in Walla Walla, Washington. The incident occurred on April 1 when the stone structure, which honors U.S. Naval Capt. Albert H. Rooks and the USS Houston CA-30, toppled over due to its instability and lack of proper support. Kaleb's father and sister were present at the scene as the monument fell, causing immediate fatal injuries to the young boy.
Kaleb's mother, who was a nurse working at a local hospital on that day, received devastating news when an ambulance brought her son in with critical injuries. She witnessed emergency medical personnel attempting resuscitation efforts but could not save Kaleb, leading to severe emotional trauma for both parents. The family has since filed a lawsuit against several companies and individuals involved in the construction and maintenance of the monument.
The defendants named in the suit include Boulder Designs, Boulder Designs Franchising LLC, Border Magic, Builders FirstSource Inc., American Rock Products, Wenzel Nursery, Double T Construction Ltd., Neil Binder, and the Binder marital community. These entities are accused of constructing and displaying a monument that was dangerously unstable due to modifications made as part of a 2019 Eagle Scout project. The lawsuit alleges that these changes replaced aging wooden elements with rock features, compromising the stability of the structure.
Following the tragic incident, Rooks Park was closed by the U.S. Army Corps of Engineers and the problematic monument was removed from the premises. While the defendants have been served notices of the lawsuit as of June 17, none have yet responded to requests for comment or filed any legal responses.
