Fertility Doctor Accused of Holding Patient Embryos Hostage Amidst License Suspension
Twenty-six families are suing a California fertility doctor, Dr. Brian Acacio, alleging he secretly moved and is now withholding their frozen embryos after his clinic closed and his medical license was suspended. Attorney Robert Marcereau, representing the families, stated at a recent press conference that Acacio was evicted from his Laguna Niguel office in December 2025 due to unpaid rent. The lawsuit claims Acacio then transported all patient embryos to an undisclosed location in Bakersfield, California, without informing the families.
The legal action seeks the immediate return of the embryos, which patients describe as a "hostage situation." Acacio reportedly demands patients sign a document absolving him of responsibility before releasing the genetic material. His medical license faced an interim restriction in October 2025 and was fully suspended on December 30, 2025, due to alleged drug use. Despite the suspension, at least one patient claims Acacio performed medical procedures in early January.
Patients reported experiencing significant disruptions in their IVF treatments, including delays, medication errors, and difficulties with embryo storage and transfer, leading up to the clinic's closure and Acacio's license suspension. The families involved in the lawsuit are seeking a court order to compel the return of their embryos, whose safety and location remain unknown. Dr. Acacio has declined to comment on the ongoing litigation.
